4. GENERAL TERMS AND CONDITIONS OF SALE
Purpose These Terms and Conditions govern the sale of products (jewelry, watches, and jewelry items) through the website siklah.com. The user accepts these terms at the time of purchase.
Products All products are accurately described with images, materials, and dimensions. Photographs are to be considered illustrative and may present slight differences from the actual product, which do not constitute a defect.
Prices Prices are expressed in Euros (€) and include VAT, unless otherwise stated. Shipping costs are clearly indicated in the cart and before completing payment.
Payment methods Payments are accepted by credit and debit card (Visa, Mastercard, Maestro networks and other major cards supported by the Stripe payment gateway).
Shipping Shipping is carried out within Italy and abroad and is free of charge. Delivery times are estimated at between 7 and 21 business days from receipt of payment. Specific times vary depending on the destination (Italy or abroad) and will be communicated during the purchase process.
Right of withdrawal Pursuant to D.Lgs. 206/2005 (Consumer Code), the consumer has the right to withdraw from the contract within 14 days of physical receipt of the product. To exercise the right of withdrawal, an explicit communication (e.g. by email) must be sent to info@siklah.com. Products must be returned intact, unused and in their original packaging. Note: Pursuant to Article 59 of the Consumer Code, the right of withdrawal is excluded for goods “made to measure or clearly personalized” (e.g. jewelry with engravings).
Warranties All products are covered by the 2-year legal warranty for lack of conformity, pursuant to the Consumer Code. In the event of a defective product, the user is entitled to have the product brought into conformity (repair or replacement) or, failing that, to a price reduction or termination of the contract.
Liability The seller is not liable for delays or service disruptions attributable to causes of force majeure (e.g. strikes, weather events, courier delays).
Alternative Dispute Resolution (ADR) Consumers residing in Europe are informed that, pursuant to EU Regulation No. 524/2013, in the event of a dispute, it is possible to file a complaint through an alternative dispute resolution (ADR) body. Such bodies can be accessed through the European Online Dispute Resolution platform. For any dispute arising from the application of these terms, an amicable resolution is encouraged by contacting our customer service at info@siklah.com.
Applicable law and competent court These terms are governed by Italian law. For any civil dispute, if the customer is a consumer, the mandatory territorial jurisdiction is that of the court of the consumer's place of residence or domicile. For all other cases (non-consumer customers), the exclusive competent court is that of Ragusa.
